SMS Messaging Privacy Policy

Five Star Energy Services (“Five Star,” “we,” “us,” or “our”) is committed to protecting the privacy of our employees and personnel who receive SMS text messages through our internal communications program. This Privacy Policy describes how we collect, use, store, and protect information in connection with our A2P (Application-to-Person) SMS messaging program.

 

2. Scope

This policy applies to all employees and authorized personnel of Five Star Energy Services who have opted into our SMS messaging program. This program is used exclusively for internal, informational communications including:

Company news and organizational announcements
Project updates and operational information
Weather alerts and field work status notifications
Job site safety reminders and compliance updates
Work order and task notifications (e.g., links to Vitruvi work orders)
Equipment and fleet policy reminders

 

3. Information We Collect

 

3.1 Information You Provide

When you opt into our SMS program, we collect:

Your mobile phone number
Your opt-in confirmation and date
Opt-out requests and dates

 

3.2 Information Collected Automatically

When SMS messages are sent and received, our messaging platform may collect:

Message delivery status and timestamps
Carrier and device type (provided by messaging infrastructure)
Opt-out actions (STOP) and help requests (HELP)

 

4. How We Use Your Information

We use the information collected solely for the purpose of operating our internal SMS communications program. Specifically, we use your mobile number and messaging data to:

Deliver operational and safety communications to employees
Confirm successful message delivery
Honor opt-out and opt-in preferences
Comply with applicable federal and state telecommunications regulations
Maintain records of consent for regulatory compliance
We do not use your mobile number or SMS data for marketing, advertising, or any commercial purpose.

 

5. Information Sharing and Disclosure

Five Star Energy Services does not sell, rent, trade, or share your mobile phone number or SMS-related personal information with third parties for their own use. We may share information only in the following limited circumstances:

With our SMS platform provider(s) and telecommunications carriers solely to deliver messages
As required by law, regulation, court order, or government authority
In connection with a corporate transaction (merger, acquisition) where data transfer is necessary, subject to equivalent privacy protections

All third-party service providers who receive your information are contractually obligated to protect it and use it only for the purposes specified by Five Star.

 

6. Data Retention

We retain mobile phone numbers and opt-in/opt-out records for as long as you are an active participant in the SMS program, plus an additional period as required by applicable telecommunications regulations (generally three years). Message delivery logs may be retained for up to twelve months for operational and compliance purposes. Upon termination of employment or upon a valid opt-out request, your mobile number will be removed from active messaging lists.

 

7. Security

We implement reasonable administrative, technical, and physical safeguards to protect your information from unauthorized access, disclosure, or misuse. Our SMS platform operates within a secure environment consistent with industry standards. However, no electronic transmission is completely secure, and we cannot guarantee absolute security.

 

8. Your Choices and Rights

 

8.1 Opt-Out

You may opt out of the Five Star SMS messaging program at any time by replying STOP to any message. After opting out, you will receive a single confirmation message and will receive no further messages unless you re-enroll. Opting out does not affect your employment status or any other rights.

 

8.2 Help

Reply HELP to any message for assistance, or contact your direct supervisor or the Information Technology department.

 

8.3 Re-Enrollment

If you opt out and later wish to re-enroll, contact the Information Technology department or your HR representative.

10. Updates to This Policy
